These Terms of Service ("Terms") govern your use of the After. website, applications, and related services (together, the "Platform"). After. is a doctor-founded medical care brand operated by LunaJoy Health, Inc. ("After.," "LunaJoy," "we," "us," or "our"). For clarity, the Platform does not include the receipt or provision of healthcare services, which are the "Medical Services."
By creating an account, starting an intake, or otherwise using the Platform, you agree to these Terms and to our Privacy Policy. Access to Medical Services is governed by the After. Medical Terms of Service, which you must accept before any clinician reviews your information or provides care. If you do not agree, please do not use the Platform.
After. is part of the LunaJoy ecosystem. LunaJoy provides management, administrative, and technology services and other non-clinical services. LunaJoy does not itself furnish the clinical evaluation and prescribing available through the Platform. Those Medical Services are provided by licensed healthcare providers employed by or contracted with Beluga Health, P.A. ("Beluga"), an independent medical professional entity, and are governed by the Medical Terms of Service. LunaJoy is not a pharmacy and is not an insurer.
By using the Platform, you acknowledge that LunaJoy does not provide medical advice, that information available on the Platform is for general informational purposes only, and that you are not entering into a provider-patient relationship with LunaJoy. You may enter into a provider-patient relationship by agreeing to receive Medical Services under the Medical Terms of Service with Beluga and its licensed providers. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room.
To use the Platform you must be at least 18 years old, be located in the United States in a state where After. offers services, not have been previously suspended or removed from the Platform, and use the Platform in compliance with applicable law. After. currently makes services available across all 50 states, subject to state law and to a provider's determination that care is appropriate in your state.
To access certain features, you must register for an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account and password and for all activity under your account. If you believe your account is no longer secure, notify customer support promptly.
Certain Products available through the Platform require a valid prescription from a licensed provider. You cannot purchase a Prescription Product unless you have agreed to the Medical Terms of Service, completed a consultation as described in the Medical Terms of Service, a provider has determined the Prescription Product is appropriate for you, and a provider has written a prescription. Current Prescription Products include compounded semaglutide and compounded tirzepatide. If a provider writes a prescription, it is sent to a licensed pharmacy for fulfillment, and the associated costs are included in the fees charged to you through the Platform.
If shipping charges apply, they will be listed at checkout, and you must pay any specified shipping charges for the address you provide.
We will attempt in good faith to deliver your Products in accordance with your order, but we are not responsible or liable for any delays or failure in delivery. We reserve the right to effect delivery in any number of separate shipments, with modes of transport and carriers decided at our discretion. Products are delivered to the address you specify, and you assume the risk for the Products once they have been delivered to that address. We are not responsible for any delay or failure to deliver due to a cause beyond our reasonable control, and in such cases we may terminate all or part of an order or reschedule delivery within a reasonable time.
Unless stated in this section, all sales of Products are final, and we do not provide refunds, returns, or exchanges. We may provide a refund or replacement if a Product is out of stock, a Prescription Product is unavailable, a Product arrives damaged or defective, or you did not receive a Product you purchased. We may require you to submit information, photos, or documentation to support a refund. If we send a replacement, you will not receive a refund. We determine pricing for all Products and services, which will be specified on the relevant product page and set out in your order confirmation. Prices are subject to change without notice, except that for a Subscription Service a price change applies at the start of your next renewal period. All fees are in U.S. Dollars and are non-refundable except as required by law or as described in Section 9. You authorize us or our third-party payment processor to charge all sums for your orders, including applicable taxes, to your payment method. After. operates on a cash-pay basis and does not bill insurance.
Certain Products, including certain Prescription Products, may be offered on a subscription or refill basis with automatically recurring payments. The Subscription Service begins on your first purchase and continues for the period you select, then automatically renews for successive periods of the same duration unless you cancel, the applicable prescription expires, or we terminate it.
If the Subscription Service is for a Prescription Product, it will not automatically renew until you complete the renewal intake and a provider reviews it and determines the renewal is appropriate. If you do not have a valid prescription on the intended renewal date, the subscription will not renew and you will not be billed until a valid prescription is processed.
You must cancel a Subscription Service at least 48 hours before the first day of the next refill or renewal period to avoid being charged for that period. You may cancel by contacting customer support or through your account. If your payment method is no longer valid when a renewal fee is due, we may suspend or terminate the affected Products and your account.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works of the Platform, or interfere with or circumvent any security or access-control feature. The Platform and all of its materials are owned by LunaJoy or its licensors and are protected by intellectual property law. There are no implied licenses in these Terms.
Certain features may allow you to submit content. You retain your rights in your content, and you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, and distribute that content as necessary to operate and improve the Platform. You represent that you have the rights to any content you submit and that it does not violate the rights of any third party. We are not obligated to monitor content and are not responsible for it.
You agree that we and those acting on our behalf may call and send you text messages at the number you provide, including operational and marketing messages, which may be sent using automated technology. Standard message and data rates may apply. You can opt out of marketing texts by replying STOP, and you can opt out of all messages by replying STOPALL, though opting out of all messages may affect your use of the Platform. Your consent to marketing messages is not a condition of any purchase. We may send you emails about our products and services, and you can opt out of promotional emails using the unsubscribe link.
You agree not to use the Platform for any unlawful purpose, harass or harm any other user, violate the rights of any third party, use automated tools to access the Platform without permission, interfere with security or operation of the Platform, perform any fraudulent activity including misrepresenting your identity or age, or resell or transfer your access. You also agree not to resell, share, or redistribute any medication obtained through After.
We may change these Terms from time to time. Revisions are effective immediately, except that for existing users material revisions are effective 30 days after posting or notice unless otherwise stated. We may require you to accept modified Terms to continue using the Platform.
These Terms are effective when you accept them or first use the Platform and continue until terminated. If you violate these Terms, your authorization terminates automatically. We may also terminate or suspend your access at any time, with or without notice. You may terminate your account at any time by contacting customer support. Provisions that by their nature should survive termination will survive.
The Platform and all materials available through it are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, or error-free. We are not responsible for damage that may result from third-party products and services, your ability or inability to obtain a prescription, or your dealings with any pharmacy, provider, or other third party.
To the fullest extent permitted by law, LunaJoy and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of, or inability to use, the Platform. To the fullest extent permitted by law, our aggregate liability for all claims arising out of or relating to the Platform or these Terms is limited to the greater of the amount you paid to After. in the 12 months before the event giving rise to the claim or one hundred U.S. dollars. This section does not limit liability for Medical Services provided by Beluga's providers, which is governed by applicable healthcare and professional liability law.
To the fullest extent permitted by law, you will defend and indemnify LunaJoy and its affiliates from any third-party claim and related liability, damages, loss, and expense, including attorneys' fees, arising out of your misuse of the Platform, your violation of these Terms or any law, or your violation of any third-party right.
These Terms, including the Privacy Policy, are the entire agreement between you and LunaJoy regarding your use of the Platform. You may not assign these Terms without our consent, and we may assign them without notice. Our failure to enforce any provision is not a waiver. If any part of these Terms is unenforceable, the remaining parts remain in effect.
Governing Law. These Terms are governed by the laws of the State of Delaware without regard to conflict-of-law principles. You and LunaJoy submit to the exclusive jurisdiction of the state and federal courts located in the State of Delaware for any permitted lawsuit or court proceeding.
Consent to Electronic Communications. By using the Platform, you consent to receive electronic communications from us, and you agree that those communications satisfy any legal requirement that they be in writing.
