LunaJoy provides management, administrative, and technology services and other non-clinical services. Beluga employs or contracts with appropriately licensed healthcare providers (the "Providers") to provide the Medical Services.
Do not use the Medical Services for emergency or life-threatening matters. For all life-threatening matters, immediately call 911 or go to the nearest emergency room.
By using the Medical Services, you consent to treatment, care, diagnosis, and the provision of Medical Services by the Providers through telehealth. You understand that telehealth has benefits and limitations compared with an in-person visit, including that a provider cannot physically examine you and relies on the information you provide. You can withdraw consent at any time by no longer seeking Medical Services. Please refer to the Privacy Policy to learn how your health information is handled.
By agreeing to these Medical Terms, you represent that you are at least 18 years old, are located in the United States, have not been previously suspended or removed from the Medical Services, and that your use complies with applicable law.
To access the Medical Services, you must complete a patient intake form about your medical history so that a Provider can identify suitable treatment options. Based on your responses, you may need to complete an additional product-specific intake form. Once your intake is complete, a Provider will review it to determine suitable treatment options, if any. For patients in certain states, where required by law or requested, the consultation also includes a synchronous live video encounter with a Provider.
Certain Products require a valid prescription from a Provider. You cannot purchase a Prescription Product unless you have agreed to these Medical Terms, the Terms of Service, and the Privacy Policy, completed a consultation, a Provider has determined the Prescription Product is appropriate for you, and a Provider has written a prescription. Current Prescription Products include compounded semaglutide and compounded tirzepatide. Compounded medications are prepared by a licensed pharmacy based on your individualized prescription. Compounded medications are not FDA approved in the same way as FDA-approved branded prescription drugs, and the FDA has not evaluated them for safety and effectiveness in that same manner.
A follow-up with a Provider, which may involve synchronous or asynchronous encounters, may be required before the renewal of any Prescription Product.
The Providers may, in their sole professional judgment, determine that you are not an appropriate candidate for treatment and are not obligated to provide care or issue a prescription, and no prescription is guaranteed. GLP-1 medications, including semaglutide and tirzepatide, carry potential risks and side effects that a Provider will discuss with you. We do not promise that any medication will produce weight loss or any other specific result, and individual results vary.
You are responsible for reviewing all information provided regarding any recommended medication, confirming that you have no allergies, contraindications, or conditions that would make the medication unsafe for you, following all treatment instructions, and using medications only as prescribed. You agree to provide complete, accurate, and truthful information to the Providers, including your medical history, symptoms, medications, and allergies, and to keep your medical information up to date. Medical Services are provided on an episodic, limited basis and are not intended to replace comprehensive primary care, ongoing disease management, or emergency services. Provider response times may vary and are not guaranteed, and the Medical Services must not be used for urgent or emergency needs, for which you should call 911 or seek immediate in-person care. You are responsible for informing your regular healthcare providers about any visits, recommendations, or prescriptions you receive through After.
The Practices reserve the right to determine pricing for the Medical Services, which will be specified on the relevant product page and set out in your order confirmation. General payment terms are set out in the Terms of Service. The Medical Services are not insurance and are not a substitute for health insurance. You authorize the Practices, or LunaJoy on their behalf, to charge the payment method you provide, which may be processed by one or more third-party payment processors.
Any outstanding balance for Medical Services rendered is your financial responsibility. The Providers do not participate in or accept any health insurance plans, and all Medical Services are offered on a private-pay basis only. The fee for a medical visit will be disclosed to you in advance of the visit.
We may change these Medical Terms from time to time. Revisions are effective immediately, except that for existing users material revisions are effective 30 days after posting or notice unless otherwise stated. By using the Medical Services, you agree that you may receive legal disclosures, these Medical Terms, the Privacy Policy, future changes, and other notices by email, text message, or secure message.
These Medical Terms are effective when you accept them or first use the Medical Services and continue until terminated. If you violate these Medical Terms, your authorization terminates automatically. The Practices may terminate or suspend your access at any time, with or without notice. You may terminate your account at any time by contacting customer support. Provisions that by their nature should survive termination will survive.
The Medical Services are intended for use only within the states of the United States that the Practices serve. The Practices make no representation that the Medical Services are appropriate elsewhere. The Medical Services are provided on an "as is" and "as available" basis, and the Practices disclaim all warranties of any kind, whether express or implied. We are not responsible for any damage that may result from third-party products and services, your ability or inability to obtain a prescription, or your dealings with any pharmacy, provider, or other third party. The limitations, exclusions, and disclaimers in this section apply to the fullest extent permitted by law.
To the fullest extent permitted by law, the Practices and Providers will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the Medical Services. To the fullest extent permitted by law, the aggregate liability of the Practices for all claims arising out of or relating to the Medical Services is limited to the greater of the amount you paid for the Medical Services in the 12 months before the event giving rise to the claim or one hundred U.S. dollars.
These Medical Terms, including the Privacy Policy and Terms of Service, are the entire agreement between you and the Practices regarding your use of the Medical Services. You may not assign these Medical Terms without our consent, and we may assign them without notice. If any part is unenforceable, the remaining parts remain in effect.
Governing Law. These Medical Terms are governed by the laws of the State of Delaware without regard to conflict-of-law principles, and you and the Practices submit to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.
